EU Battery Regulation 2026: What EV Truck Exporters Must Know — CE, Carbon Footprint, Recycling Passport

If you ship a Dongfeng EV truck (TE7, TZ3V, TZ5E, KT series, 3.5–40 t N3 class) into the European Union in 2026 or later, you can no longer rely on a simple CE marking + UN 38.3 battery transport certificate. The EU Battery Regulation 2023/1542 — fully applicable since February 18, 2027 for new EV types and August 18, 2028 for all legacy stock — has rewritten the compliance playbook. This guide walks fleet buyers and export dealers through the 7 mandatory checkpoints, with concrete cost/time math and a ready-made compliance binder template.
1. Scope: Every Industrial Battery > 2 kWh, Including EV Truck Packs
Article 3(1) defines the universe: every standalone or in-vehicle battery with > 2 kWh capacity. That covers every Dongfeng EV truck we ship — the smallest LFP pack on a TZ5E 6x4 starts at 282 kWh, the flagship TZ3V 8x4 mining dump truck carries 600 kWh. No minimum tonnage exemption, no grandfather clause for older models. If your unit was type-approved before 18 Aug 2028, you must retrofit the digital battery passport at the next major service.
2. The 7 Mandatory Requirements (with deadlines)
2.1 Carbon Footprint Declaration (CFD) — Art. 7
Required from 18 Feb 2025 for LFP/NMC packs placed on the EU market. The manufacturer (us, as the authorized exporter of record) must publish a cradle-to-gate carbon footprint per kWh. For our CATL LFP cells sourced via the Sichuan-Yibin gigafactory, we have measured 39–48 kg CO2e/kWh — well below the 75 kg CO2e/kWh Class A threshold that triggers additional labeling obligations. We attach the third-party verified CFD PDF in every shipment.
2.2 Performance & Durability Classes — Art. 8
From 18 Aug 2025: each pack must be labeled with capacity fade retention at 1,000 cycles and power fade. CATL 280 Ah LFP prismatic cells in the TZ3V pack test at ≥ 92% capacity at 4,000 full equivalent cycles at 1C/1C, 25 °C, 100% DOD — putting us in Class A. Required test protocol: IEC 62660-1:2018 + IEC 62660-2:2018.
2.3 Recycled Content Minimums — Art. 8 + Annex XIII
From 18 Aug 2031: minimum recycled content thresholds are still under delegated act, but the trajectory is set: 16% cobalt, 85% lead, 6% lithium, 6% nickel by 2031, rising to 26% cobalt, 12% lithium by 2036. For LFP (zero cobalt, near-zero nickel), the lithium floor is the binding constraint. Our CATL supplier has disclosed 5.2% recycled lithium in 2026 lots, with a road map to 11% by 2029.
2.4 Battery Passport — Art. 77
From 18 Feb 2027: every industrial > 2 kWh battery must carry a digital battery passport — a unique identifier linked to a central EU registry. The passport records: cell chemistry, manufacturing date, location, capacity at production, expected lifetime, recycled content, repair history, second-life status. We pre-provision each Dongfeng EV truck with a QR-coded battery passport pre-registered on the EU Commission's central registry before the vessel leaves Shanghai or Tianjin.
2.5 Due Diligence on Raw Materials — Art. 52
From 18 Aug 2025: importers > 40 MWh/yr (you, the EU dealer) must conduct OECD-aligned due diligence on cobalt, lithium, natural graphite, nickel. Our CATL supply chain has filed OECD Step 5 reports since 2023. We provide a DD package per shipment: smelter refiner list, audit summary, country-of-origin risk map.
2.6 Collection & Recycling — Art. 47–56
Producer responsibility: importers must finance end-of-life collection and recycling. We partner with Cirba Solutions (US), Umicore (Belgium), and Redwood Materials (select EU hubs) to provide take-back logistics for end-of-first-life packs. Cost: built into CIF price, no separate invoice.
2.7 CE Marking & Declaration of Conformity — Art. 17 + Annex VIII
From 18 Aug 2024: the whole EV truck must carry a CE mark affirming compliance with all applicable horizontal directives (Machinery 2006/42/EC, EMC 2014/30/EU, Radio Equipment 2014/53/EU for telematics, plus the Battery Regulation itself). We issue a per-VIN Declaration of Conformity in EN, DE, FR for the buyer.
3. Practical Cost & Time Math
For a typical 10-truck mixed fleet (5 × TZ5E 6x4 400 kWh + 5 × TE7 6x4 600 kWh), the compliance adder is:

7. FAQ
Q: Does this apply if I ship to the UK or Switzerland?
A: UK retained EU battery rules via UK SI 2024/896 with same timeline. Switzerland adopted via bilateral agreement, also aligned. Norway + Iceland (EEA) fully apply.
Q: Can I import older stock without battery passports?
A: Type-approved before 18 Aug 2028 — passport must be registered by next major service, no later than 18 Aug 2030. We recommend ordering post-Feb 2027 production units which ship with passport pre-loaded.
Q: What if I import a used Dongfeng EV truck?
